INFORMATION ON THE PROCESSING OF PERSONAL DATA PURSUANT TO ART. 13 OF D. LGS. 30 JUNE 2003 No 196 E SS. MM. ("Privacy Code")

AGS Parts informs you that the data you provide when you access the www.ags-parts.com site ("Site") and the interaction with it and/or the installation of the mobile application called "AGS Parts App" and its subsequent use, will be processed in accordance with the provisions of this policy (hereafter, "Information").
1. Data controller/b>
The data controller is AGS Corporation Ltd, in the person of the legal representative pro tempore, with registered office in England AL9 7NT, 8 Alpha Business Park, Welham Green, Hertsfordshire, Company House Number 08778135, registered within the Company House UK (hereafter, "AGS Parts").
2. Purpose and method of processing
AGS Parts treats your personal data for the following purposes:
(a) for registration on the Site and/or to download the App, or to proceed to purchase goods or services through the Site and, therefore, to carry out any activity related, in particular, to the selection of products or services, the sending of orders and/or the relative acceptance, delivery and/or possible exercise of the right of withdrawal and the consequent withdrawal of the goods or any other fulfillment provided for in the conditions of sale;
(b) to allow the use of services reserved for registered users as per the conditions of use of the site where the provision of services is provided at the user's request, such as the sending of informative newsletters of interest to the registered user, the sending of messages to receive customer support, for the booking of goods and services, for the reporting to third parties of goods and services, for the issue of reviews and comments by users in appropriate online forms;
(c) for the performance of any administrative and accounting activity related to the registration to the Site and/or the App, to the making of a purchase on the Site and/or through the App, as well as to fulfill legal obligations;
(d) for the sending of communications aimed at the promotion and/or direct sale of products or services similar to those already purchased/used by the user, pursuant to art. 130, paragraph 4, of the Privacy Code, (so-called "soft spamming"), without prejudice to the right of the user to object at any time;
(e) for the sending of commercial communications on AGS Parts products and services and third parties, special offers, promotions and news, coupons, for carrying out market research, by means of automated systems, e-mails, sms, mms, faxes, or the like, and/or by means of the postal service (so-called marketing purposes; optional consent);
(f) for the analysis of consumer preferences and habits and the processing of personal preferences and user interests through automated systems and the transmission of personalized offers through the Site and the App (so-called "profiling" purposes, optional consent).
Personal data are processed with electronic tools and are stored in the electronic database in charge. The personal data contained in the aforementioned automated information system, as well as those stored in the Data Controller's archives, are processed in accordance with the provisions of the Privacy Code regarding security measures, in order to minimize the risks of destruction or loss, unauthorized access or processing not in accordance with the purposes of the collection. Personal data are also stored for the time necessary to achieve the above-mentioned purposes, as well as to fulfill the legal obligations imposed for the same purposes.
3. Types of personal data processed
AGS Parts processes personal data freely entered by the user on the Site and/or on the App, or entered by the user through a link to social platforms (such as, in particular, personal data, tax codes, contact details, telephone and/or fax numbers, e-mail addresses, data contained within comments or reviews, etc.), as well as data of a technical nature independently generated (in particular, IP addresses, log files related to navigation on the Site, purchases made, etc.).
AGS Parts will keep, within the legal terms, the log files and IP addresses used when making an online purchase, in order to prevent and detect any fraud in online transactions.
4. Credit card data
To make a payment on the Site by credit card, the user must enter the confidential credit card details (card number, holder, expiration date, security codes). This data will be acquired by the payment service provider who will act as the autonomous data controller, without passing through AGS Parts server.
The data will be acquired in encrypted format and according to the security requirements of the SSL certification.
AGS Parts will only keep track of the last four digits that make up the credit card number and the expiration date of the credit card only and exclusively to prevent any fraud in online payments.
5. Provision of data and consent to the related processing – Consequences in case of non-provision
The provision of data for the purposes referred to in points (a), (b) and (c) of art. 2 above is necessary and, therefore, failure to provide the personal data in question will make it impossible for the user to conclude the procedures for the purchase, delivery and/or return of the goods, to use the services reserved for registered users or from the latter requested from time to time as indicated in the conditions of use of the Site, as well as the performance of administrative and accounting activities by AGS Parts . Consent to the processing of personal data for the aforementioned purposes is not required, in particular pursuant to art. 24, paragraph 1, subparagraph b), of the Privacy Code.
With reference to the purpose referred to in point (d) of art. 2 above, consent to processing is not necessary pursuant to art. 130, paragraph 4, of the Privacy Code, without regard to the user's right to object at all times to the sending of communications. With reference to the purpose of the processing referred to in point (c) of art. 2 (so-called "marketing") purposes, consent to the processing of personal data is merely optional, it being understood that its failure to provide it will make it impossible for the user to receive informative and/or commercial communications relating to AGS Parts products and/or services or third parties, with the sole exception of soft spamming (except, in any case, opposition to the same as indicated above).
In case of non-consent to the processing of data, AGS Parts may process the data for the purposes referred to in point (d) of art. 2 unless the user subsequently objects. With reference to the purpose referred to in point (f) of Art. 2 above (so-called "profiling" purposes), consent to the processing of personal data is merely optional. AGS Parts will process the personal data freely provided by the user at the time of registration (e.g. contact details, age, profession, etc.) together with data generated by AGS Parts 's information systems (in particular log files relating to searches carried out by the user and/or pages visited, purchases made, etc.). Failure to give consent to the processing of personal data for the purposes referred to in art. The above article 2(f) will make it impossible for AGS Parts to analyze the user's consumption habits in order to process and send specific offers based on the user's tastes and preferences.
6. Rights of data subjects
In accordance with Art. 7 of the Privacy Code, the data subject has the right to obtain confirmation of the existence or not of personal data concerning him, even if not yet registered, and their communication in an intelligible form.
(a) the origin of personal data; (b) the purpose and methods of processing; c) the logic applied in case of treatment carried out with the use of electronic instruments; d) the identification details of the owner, the managers and the representative designated pursuant to article 5, paragraph 2, of the Privacy Code; (c) the persons or categories of persons to whom personal data may be disclosed or who may become aware of them as a designated representative in the territory of the State, as managers or persons in charge.
(a) updating, rectification or, where interested in it, data integration; b) the deletion, anonymous transformation or blocking of data processed in violation of the law, luding those that do not need to be stored in relation to the purposes for which the data was collected or subsequently processed; (c) proof that the transactions referred to in (a) and (b) have been brought to the attention, luding as regards their content, of those to whom the data have been communicated or disseminated, except where such performance proves impossible or involves the use of means manifestly disproportionate to the protected right.
Finally, the data subject has the right to object, in whole or in part: a) for legitimate reasons to the processing of personal data concerning him, even if they are relevant to the purpose of collection; b) the processing of personal data concerning him for the purpose of sending advertising material or direct sales or for the purpose of carrying out market research or commercial communication.
